Storygeny AI – Terms of Service

These Terms of Service ("Terms") apply when you access and use Storygeny AI and other software, tools, services, documentation, content, functionalities, and generative AI features that we make available to you through any Storygeny or Bouesse Technologies product (collectively, "AIs"). These Terms are a legally binding agreement between you and Bouesse Technologies ("Bouesse", "we", "our", or "us").

Eligibility

You cannot access AIs if you are under the age of 13 (or any higher age required in your country or territory) or if applicable laws prohibit you from receiving our services or software.

Acceptable Uses

You may not access, use, or allow others to access or use AIs in any manner that would:

• Be unlawful (including but not limited to promoting, contributing to, or encouraging illegal activity), including conduct that describes, encourages, supports, or distributes child sexual abuse material.
• Generate, promote, disseminate, or use content that may harm individuals, including encouraging self-harm, discrimination, bullying, humiliation, or emotional injury.
• Present a risk of death or bodily harm (including topics related to illegal drugs, weapons, or self-harm).
• Produce or facilitate adult content (erotic chat, pornography, or content meant to arouse sexual excitement).
• Deceive or mislead others, including plagiarism, scams, phishing, malware, or misinformation/disinformation.
• Infringe upon the rights of others (including intellectual property, privacy, or personality rights).
• Solicit professional advice (medical, psychological, financial, legal, etc.) or generate content intended for use in regulated activities (including political campaigning or lobbying). Outputs are not a substitute for qualified professional advice.
• Attempt to override or bypass safety, privacy, or security controls.

Prompts, Results, and Other Content

Rights to Content: You retain all rights to your Prompts except as otherwise provided in these Terms. You may not submit Prompts that violate these Terms or infringe another party’s rights.

Storygeny AI Data: The Storygeny Privacy Policy governs our processing of personal information used by AIs, including information in Prompts, Feedback, device information, and activity data. AIs may retain and use submitted information to improve personalization and service quality. Do not share information you do not want the AIs to retain (e.g., credentials, financial data, highly sensitive data). If the AIs cannot answer a query or determine that information from a partner is more relevant, we may share the Prompt and limited metadata with a third-party search or data provider to obtain a suitable response. Information shared may include personal data if included in your Prompt. By using AIs, you instruct us to share your information with such third parties as needed. Third-party providers will process shared information under their own privacy policies. Storygeny may review your interactions with AIs—automatically or manually, including through third-party vendors. Depending on your residence, you may request access, deletion, or correction of your personal information as permitted by law. Visit our Privacy Center to learn how to exercise your rights.

Accuracy

AIs are evolving technologies. Outputs may be inaccurate, incomplete, outdated, or disturbing. You may not rely on Outputs for professional, medical, financial, legal, safety-critical, or other regulated purposes. You alone are responsible for verifying Outputs.

Warning Regarding Content

Outputs are generated based on your Prompts and cannot be predicted in advance. You acknowledge that Outputs may be offensive, objectionable, or disagreeable, and may not reflect the views of Storygeny. You are solely responsible for your use of such Outputs.

Storygeny Rights

Rights Regarding Content: Storygeny may use Content, including via automated or human review and third-party vendors, to provide, maintain, and improve Storygeny AI services, conduct and support research, monitor compliance with these Terms and applicable laws, remove content that violates these Terms or Storygeny policies, and suspend or remove accounts for violations.

Suspension and Termination

We may suspend or disable your access to AIs—or your entire account—if you violate these Terms or other applicable policies or if legally required.

Ownership of AIs

Bouesse Technologies retains all rights, title, and interest in and to Storygeny AI, including all intellectual property. These Terms do not grant you any ownership rights in AIs.

Third-Party Materials and AI

AIs may use or be used with third-party tools, content, or technologies ("Third-Party Materials and AI"). Bouesse Technologies is not responsible for your use of third-party services. You use them at your own risk.

Accuracy of Outputs and Limitations on Liability

Accuracy of Outputs: AIs may contain errors or inconsistencies. We do not guarantee they will be safe, uninterrupted, or error-free. You are solely responsible for verifying Outputs and assessing their suitability.

Limitations on Liability: Nothing limits our liability where prohibited by law (e.g., for death or personal injury due to negligence, or fraudulent misrepresentation). We exercise professional diligence in delivering the AIs. Provided we meet that obligation, we are not responsible for losses not caused by our breach, losses not reasonably foreseeable at the time of agreement, or events beyond our reasonable control.

Disputes

Any claim, cause of action, or dispute that arises out of or relates to these Storygeny AIs Terms is subject to the disputes resolution clause in the Storygeny Terms of Service.

Severability

If any part of these Terms is unenforceable, it will be modified to the minimum extent necessary or severed. Failure to enforce any provision is not a waiver. Any amendment must be in writing and signed by us.

Changes to These Terms

We may update these Terms to reflect changes to our services, improve safety, or comply with law. Unless legally required, we will notify you of changes and allow time for review. Continued use of AIs after changes take effect means you accept the updated Terms. If you do not agree, discontinue using AIs.
